Vice President (Article 63)
The provisions related to the Vice President in the Constitution are adopted from the US Constitution.
The Vice President of India would have been the ex-officio Chairman of the Rajya Sabha. (Article 64 and Article 89)
Eligibility
The Vice-President is not a member of the Rajya Sabha, so he does not have the right to vote, but he has the right to vote decisively as Chairman. The Vice-President may cast a casting vote in the Rajya Sabha.
A person shall be eligible to be elected Vice-President only if he –
1. Be a citizen of India.
2. Has completed the age of 35 years.
3. Be eligible to be elected a member of Rajya Sabha.
4. Should not hold any office of profit at the time of election.
5. He cannot be a member of a House of Parliament or a House of State Legislature and if such a person is elected Vice-President, it shall be deemed that he has vacated his place of that House from the date of his office.
The Vice President has to take an oath before the President or any person appointed by him before assuming his office.
Term of Vice-President (Article 67): The Vice-President shall hold office for a period of five years from the date of assuming office. But
(a) The Vice-President may resign his post by writing his signature addressed to the President.
(b) The Vice-President may be removed from his office by a resolution of the Rajya Sabha which is passed by a majority of the then and all members of the Rajya Sabha and to which the Lok Sabha agrees.
(c) The Vice-President will continue to hold office until the term of his term expires until his successor takes over.
Disputes relating to the election of the Vice President are settled by the Supreme Court. When elections are illegal, the work done by him is not illegal.
The same person can be elected to the post of Vice President as many times as he wants.
For the Vice President candidate, the electorate consists of a 20 Member proposer and a 20 Member endorser, through the Proportional Representation System and the Single Transferable Vote System.
The Vice-President serves as the President if the President is vacant. (Article – 65)
The maximum term for the Vice President to act as President is six months. During this time, it would have been mandatory to get the President elected. While acting as the President, the Vice-President will have the right to all the powers, immunities, achievements, allowances and privileges of the President.
Note: Any term in which the Vice-President serves as the President shall not perform the functions of the office of the Chairman of the Rajya Sabha and shall not be entitled to the salary or allowances of the Chairman of the Rajya Sabha under Article 97.
